“If a man comes upon a girl who is a virgin but who is not engaged, and he grabs her and has sexual relations with her, and they are caught in the act, then the man who had intercourse with her must give to the girl’s father one-and-a-quarter pounds of silver shekels, and she will become his wife, because he humiliated her; he may not divorce her as long as he lives.”-Deuteronomy 22:28-29
We now come to the final sexual offense presented to us here in the latter half of Deuteronomy Chapter 22.
A man decides to have sex with a woman who is neither married nor engaged to another man.
In this case, the death penalty is NOT handed down for either party.
Do you know what this tells us?
This tells us that if an unmarried couple (meaning both the man and woman are single) has sex, it is neither adultery or fornication.
And keep in mind, I’m going by the Biblical definition of fornication here, not the secular definition which mistakenly says sex between an unmarried man and an unmarried woman is fornication.
It is not.
For more on this topic, read this article.
Discussing the true Biblical meaning of fornication is a whole other topic in and of itself that I’ll deal with later and by the way something the Christian church gets totally wrong.
Anyway, let’s get back to the topic at hand.
We’re talking about a man who has just had sex with an unattached young girl.
When I say unattached, in this context, I mean she is neither married nor engaged but is still living in her father’s home.
This would be just like a teenage girl in our day who is still living at home and goes out on a date with some dude and in the heat of the moment they decide to engage in some horizontal boogie-woogie.
While this is not ideal from the Lord’s perspective, it is hardly the same as a man having sex with a woman who is married or engaged to another man and neither is it a form of rape.
Again, this is simply a situation of two willing but unmarried partners (only a man and woman, NOT a man and man), who decided to have sex with each other.
What is the end result?
The Scripture tells us they must marry.
Why?
Because the girl was still under the ownership of her father.
Think about it.
The man has forever taken away the girl’s virgin status which means her father will have very little chance (if ever) to properly marry this girl off in the future.
That’s why the young man has to pay the father the unusually high bride price of 50 silver shekels AND…
…he has to marry her and can NEVER divorce her.
Now what if this young man had sex with a single woman who was completely unattached meaning she was not living under her father’s authority and was neither engaged nor married to another man?
The Scripture doesn’t make that clear but let’s just think about this for a moment.
Here in Deuteronomy we are presented with a situation of a single man having sex with a single woman living under her father’s roof and…
…the only penalty is that the young man has to pay a bride price to the father.
Thus, could not one logically conclude that a if a single man has sex with a single woman who is not living under her father’s house and is not engaged or married to another man, the penalty would be even less severe or heck maybe there isn’t even a penalty at all?
To conclude, this situation is obviously NOT adultery because no death penalty is handed down and…
…this is NOT fornication because this instance is not included at all in the list of forbidden sexual acts given us in Leviticus Chapter 18.

It sin .Not all sin was in the law death .A verse is not the whole and you do not bother to read the whole -Deuteronomy 22:28-29 Is not approving what they did … Oh and the Torah is nothing to a Biblcial believer .They live under grace not the law for the law was for the unrighteous . But we have foolish people today acting like Galatians and we know what Paul called them .But many today hate Paul … These folks are reprobates

Myriam & Yosef says
“Therefore a man shall leave his father and his mother and hold fast to his wife, and they shall become one flesh. And the man and his wife were both naked and were not ashamed.” Genesis 2:24-25.
“For this is the will of God, your sanctification: that you abstain from sexual immorality; that each one of you know how to control his own body in holiness and honor, not in the passion of lust like the Gentiles who do not know God….”1 Thessalonians 4:3-5.
Now for the matters you wrote about: “It is good for a man not to have sexual relations with a woman.” 2 But since sexual immorality is occurring, each man should have sexual relations with his own wife, and each woman with her own husband. 1 Corinthians 7:1-2
“Now to the unmarried[a] and the widows I say: It is good for them to stay unmarried, as I do. 9 But if they cannot control themselves, they should marry, for it is better to marry than to burn with passion.” 1 Corinthians 7:8-9.
Having sex for having sex with another person without being married is LUST (A sin that it is clear in all the Scriptures) because it is not commitment there. It is only to satisfy the FLESH and not caring about the other person using each other as an object, there is not LOVE if there is not commitment. Why a believer of the Truth would engage is such activities? Our Elohim is a G-d of Covenants and the marriage is a representation of Yeshua and the Bride. Please, do not confuse young people who are trying to get out of (youthful passions) like the Scriptures says to stay away from these specific things. This article encourages to sin in this way. I thought you not only follow of the Torah but of the teachings or Yeshua and his disciples which are in completely harmony with the Torah because Yeshua is the Living Torah. Sex outside marriage is a SIN. Period.

Sadly very misleading coming from someone that confesses that he is follower of Torah..
Gus says
Yeshua didn’t mention sex outside of marriage and its not prohibitted in the Torah. You are only quoting Paul. Paul added MUCH to Yeshua’s message like how women can not speak in church, and the “once saved, always saved” concept.
